AI & Licensing Policy

This policy explains how 848 Artworks (“we”, “our”, “us”) uses generative artificial intelligence (AI) in the creation of visual works, how we disclose that origin, and what rights you (the “Customer” or “Licensee”) receive when you purchase from us.
1. Purpose & Scope

3. Human Creative Contribution
Although AI systems assist in generating raw imagery, a human artist at 848 Artworks makes all final creative decisions, including but not limited to:

Selecting which AI outputs are kept or discarded.

Making compositional, color, and stylistic adjustments (digital editing/retouching).

Curating images into cohesive collections and ensuring thematic consistency.

Determining print materials, sizes, and presentation formats.
This human oversight is integral to authorship and originality. We treat each final piece as the result of a human‑led creative process.

We practice layered transparency so you always know the origin of our works:

5. Licensing & Rights You Receive
We offer different tiers of rights depending on the product type (single image, pack, subscription, etc.). Unless a product page or order confirmation states otherwise, the default rights are:
5.1 Personal Use License (default for consumers)

You may display, print, and gift the artwork for personal, non‑commercial purposes.

You may not resell the digital file or reproduce it on merchandise for sale.
5.2 Commercial License (when indicated)

You may not claim to be the original creator of the underlying artwork (see Section 6), but you may brand the products that incorporate the artwork as your own.
Important: Always refer to the specific product description or order confirmation for the exact license attached to that purchase. If terms conflict, the order‑specific license supersedes this general policy.
6. Attribution, Restrictions & Prohibited Uses

No Misrepresentation of Origin: You may not imply that you or your brand originally created the artwork without modification, especially if resale rights are not part of your license. “Designed by [Your Brand]” is acceptable when you incorporate the artwork into a larger product or design.

No Unlawful / Harmful Use: Do not use the artwork in ways that are illegal, defamatory, or infringe upon third‑party rights (e.g., likeness rights, trademarks).

No Use of Celebrity Likenesses Without Permission: Our policy is to avoid creating or selling works that depict identifiable real people without their consent. If you believe a work resembles a real individual, contact us for removal or replacement.

No Training Data Reuse: You may not use our artworks to train machine learning models without explicit written permission.
7. Compliance & Record‑Keeping

We maintain internal records (prompts, edits, metadata logs) to substantiate human authorship and AI involvement, consistent with evolving regulations (e.g., EU AI Act) and copyright guidelines.

Upon reasonable request (e.g., for legal compliance), we can provide documentation of origin and license terms for a specific work you purchased.
8. Updates to This Policy
